These Terms of Service ("Terms") are a legally binding agreement between you ("User," "you," or "your") and HC DESENVOLVIMENTO DE SOFTWARES LTDA ("HearQA," "we," "us," or "our"), a company organized under the laws of the Federative Republic of Brazil, with its registered office at Rua Guaicui, 715, CEP 30.380-342, Bairro Luxemburgo, Belo Horizonte, MG, Brazil.
These Terms govern your access to and use of the HearQA platform, available at hearqa.com.
1. Acceptance of Terms
By creating an account, accessing, or using HearQA, you agree to these Terms, our Privacy Policy, and our Responsible Use Policy. If you do not agree to any part of these Terms, you must not use the Service.
These Terms apply to all visitors, registered users, and any person who accesses or uses HearQA in any capacity. We encourage you to read these Terms carefully before using the Service.
2. Eligibility
You must be at least 16 years of age to create an account or use HearQA. If you are between 16 and 18 years of age (or the age of legal majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
By using HearQA, you represent and warrant that you have the legal capacity to enter into a binding agreement and that your use of the Service does not violate any applicable law or regulation.
3. Description of Service
HearQA is a web-based AI copilot delivered as a Progressive Web App (PWA) designed for high-stakes professional and academic situations. The Service provides the following capabilities:
- Real-time audio transcription of microphone and browser tab audio
- Camera and photo capture with optical character recognition (OCR)
- Video capture and analysis for recording on-screen content, whiteboards, or documents (up to 20 seconds per clip)
- Screen capture for desktop environments
- Document upload and AI-grounded responses using retrieval-augmented generation (RAG)
- AI coaching and assistance powered by large language models
- Session summaries and performance reviews
- Six specialized templates: Interview, Exam, Certification, Presentation, Conversation, and Practice
- Eight supported languages: English, Portuguese, Spanish, Hindi, Japanese, Korean, French, and German
HearQA is accessible at hearqa.com and is designed for use in modern web browsers on desktop and mobile devices. The Service is intended as a supportive tool and does not replace professional judgment, expertise, or advice.
4. Account Registration and Security
To access HearQA features, you must create an account using Google Sign-In or an email and password combination.
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately via the contact form in your portal if you suspect unauthorized access
One account per person. Creating multiple accounts to circumvent plan limits or for any other purpose is prohibited. We reserve the right to suspend or terminate accounts that violate these Terms, with or without prior notice depending on the severity of the violation.
5. Subscriptions, Payments, and Billing
HearQA offers three plans:

Free — $0/month
- 3 sessions per month, 15 minutes each
- 5 AI responses per session, 15 per month
- 5 documents, 3 MB storage

Session Pack — $44.99 one-time purchase (stackable, 7-day window)
- A consumable top-up that adds capacity to your current plan (Free or Pro). It does not replace your plan or change its status.
- Each Session Pack adds: 5 sessions, 90-minute durations, unlimited AI responses, unlimited photos, and 50 video minutes.
- A Session Pack does not change your document slots or your storage — those remain at your underlying plan's limits.
- Can be purchased multiple times; the credits stack additively. Each pack's credits expire 7 days after that pack is purchased.

Free has explicit caps on AI responses and photos; Pro and Session Pack are unlimited on those metrics within the session count and 90-minute duration ceilings. Session count, duration, video minutes, document count, and storage remain capped on every plan. Fair-use applies — we reserve the right to investigate or throttle accounts that exceed reasonable use patterns (10,000+ AI responses per month is the abuse-detection threshold). Current caps are documented on the Plans page and may be adjusted with prior written notice.
When you reach your limits. When a capped plan metric (sessions, video minutes, uploads, or storage; AI responses and photos only on Free) is exhausted, the Service returns an HTTP 402 "Payment Required" response with error code LIM_001 and surfaces a "Limit reached" modal. Quota is consumed in this order:
- Your active plan's monthly quota (Free, Pro Monthly, or Pro Yearly)
- Any Session Pack credits you have purchased (oldest non-expired pack first)
- Once both are exhausted, further calls are blocked until the next billing period or until you purchase additional capacity
Session Pack as top-up. If you reach your session-count or video-minute limits and need more capacity before your next billing cycle, you may purchase one or more Session Packs at $44.99 each. Each Session Pack adds 5 sessions and 50 video minutes on top of your active plan, with unlimited AI responses and photos within those new sessions; it does not add document slots or storage, and does not alter your subscription status. Each pack's credits expire 7 days after that pack is purchased; when you hold more than one pack, credits are drawn from the pack expiring soonest.
Payment processing and Merchant of Record. Payments are processed by Paddle.com Market Limited ("Paddle"), our authorized Merchant of Record (MoR). Paddle is responsible for billing, payment processing, sales tax / VAT collection and remittance, refunds, and chargebacks on our behalf. By making a purchase, you also agree to Paddle's Buyer Terms of Service and Refund Policy. HearQA does not store your full payment card details. All prices are in United States Dollars (USD); Paddle may display them in your local currency at checkout.
Auto-renewal. Pro and Annual subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the then-current subscription price at each renewal.
Price changes. We may adjust subscription prices with at least 30 days' prior written notice sent to the email address associated with your account. The new price takes effect at your next billing cycle after the notice period. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.
Manage your subscription. You can view, modify, or cancel your subscription at any time through Settings > Manage Subscription in the HearQA portal, which redirects to the Paddle Customer Portal.
6. Cancellation and Refunds
You may cancel your subscription at any time through Settings > Manage Subscription in the HearQA portal or by using the contact form in your portal. Upon cancellation, you retain access to paid features through the end of your current billing period.
Refund rights depend on your jurisdiction as described below. In all cases, refunds are processed within 7 to 10 business days via Paddle to the original payment method.
6.1 Brazil (Codigo de Defesa do Consumidor, Article 49)
If you are a consumer located in Brazil, you have the right to cancel any purchase within 7 calendar days from the date of purchase for a full refund, without the need to provide any justification ("direito de arrependimento"). This right applies to all paid plans, including Session Packs.
To exercise this right, use the contact form in your portal or cancel through the portal within the 7-day period.
6.2 European Union / European Economic Area (Consumer Rights Directive 2011/83/EU)
If you are a consumer located in the EU or EEA, you have the right to withdraw from any purchase within 14 calendar days from the date of purchase for a full refund, without the need to provide any justification.
If you have actively used the Service during the withdrawal period (for example, by starting sessions or consuming AI responses), we may deduct an amount proportional to the services already provided up to the point of withdrawal.
To exercise this right, send a clear statement of withdrawal via the contact form in your portal or cancel through the portal within the 14-day period.
6.3 All Other Regions
For users outside Brazil and the EU/EEA, we offer a 30-day refund policy for first-time purchases. If you are dissatisfied with HearQA within 30 days of your first paid subscription or Session Pack purchase, you may request a full refund by using the contact form in your portal.
After 30 days, or for subsequent purchases, cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods after the initial 30-day window.
6.4 Session Pack Refunds
Session Packs are refundable within the applicable withdrawal period for your jurisdiction (7 days for Brazil, 14 days for EU/EEA, 30 days for all other regions on first purchase) provided that unused sessions remain. If all sessions have been fully consumed, no refund is available except where required by applicable law.
7. Free Plan
The Free plan provides access to HearQA at no cost, subject to the usage limits described in Section 5. No payment information is required.
HearQA reserves the right to modify the features, limits, or availability of the Free plan at any time. We will provide reasonable notice of material changes through the platform or via email where possible.
The Free plan is provided for individual, non-commercial evaluation. Abuse of the Free plan, including creating multiple accounts to circumvent limits, may result in account suspension.
8. User Content and Intellectual Property
Your Content
You retain full ownership of all content you create, upload, or transmit through HearQA, including documents, audio transcriptions, session data, and any other user-generated material ("User Content"). HearQA does not claim ownership over your User Content.
You grant HearQA a limited, non-exclusive, non-transferable license to process, store, and transmit your User Content solely for the purpose of delivering the Service to you. This license terminates when you delete your content or your account is closed.
Our Platform
HearQA and its licensors retain all rights, title, and interest in and to the Service, including all software, algorithms, designs, trademarks, trade names, logos, and other intellectual property. Nothing in these Terms grants you any right to use our branding or intellectual property beyond accessing the Service as a user.
AI-Generated Responses
AI-generated responses provided by HearQA are offered as guidance only. HearQA makes no claim of ownership over AI-generated content. These responses are produced by third-party AI models and are not guaranteed to be accurate, complete, or suitable for any particular purpose. You use AI-generated responses at your own discretion and risk.
9. Responsible Use
Your use of HearQA is subject to our Responsible Use Policy, which is incorporated into these Terms by reference.
You are solely responsible for ensuring that your use of HearQA complies with all applicable local, state, national, and international laws and regulations, as well as any policies of your employer, educational institution, or professional organization.
10. Recording Consent
HearQA enables real-time audio transcription and screen capture. You are solely responsible for ensuring that you have obtained appropriate consent from all parties whose audio, video, or screen content may be captured or transcribed through the Service.
Recording and surveillance laws vary significantly by jurisdiction. Some jurisdictions require the consent of all parties to a conversation ("all-party consent"), while others require only one party's consent ("one-party consent"). It is your obligation to understand and comply with the laws that apply to your situation.
HearQA is not responsible for your failure to obtain required consent, and you agree to hold HearQA harmless from any claims arising from unauthorized recording or transcription.
11. Prohibited Uses
You agree not to use HearQA to:
- Violate any applicable law, regulation, or legal obligation
- Engage in fraud, impersonation, or misrepresentation of identity
- Mislead others about your qualifications, credentials, or competence
- Infringe on the intellectual property, privacy, or other rights of any third party
- Disrupt, overload, or interfere with the operation of the Service or its infrastructure
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service
- Conduct unauthorized surveillance or monitor individuals without their knowledge or consent
- Share your account credentials with others or allow third parties to access your account
- Create multiple accounts to abuse the Free plan or circumvent plan limits
- Use automated scripts, bots, or other tools to interact with the Service without authorization
- Transmit malicious software, viruses, or harmful code through the Service
HearQA reserves the right to investigate suspected violations and to suspend or terminate accounts engaged in prohibited conduct.
12. AI-Generated Content Disclaimer
HearQA uses artificial intelligence models, including AWS Bedrock (Claude 3.5 Haiku) and Google Vertex AI (Gemini), to generate responses, summaries, and coaching feedback.
AI-generated content may contain errors, inaccuracies, or omissions. You should independently verify any information provided by the AI before relying on it for decisions that affect your career, education, health, finances, or legal standing.
AI-generated responses are not a substitute for professional advice from qualified attorneys, physicians, financial advisors, or other licensed professionals. HearQA is not responsible for any actions, decisions, or outcomes that result from your reliance on AI-generated content.
13. Privacy
Your privacy is important to us. Our Privacy Policy describes how we collect, use, store, and protect your personal information. By using HearQA, you acknowledge that you have read and understood our Privacy Policy.
Key points include:
- Audio transcription is processed in real time and not stored beyond your session unless you explicitly save it
- Documents you upload are stored securely and used only to provide AI-grounded responses
- We do not sell your personal data to third parties
- You may request deletion of your account and data at any time

14. Warranty Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEARQA DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- The results obtained through the Service will be accurate or reliable
- Any defects in the Service will be corrected
- The Service will meet your specific requirements
Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply only to the extent permitted by law.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
HearQA's total aggregate liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the total amount of fees you paid to HearQA in the 12 months immediately preceding the event giving rise to the claim. If you have not paid any fees, our total liability shall not exceed USD $50.00.
HearQA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, regardless of the theory of liability and even if HearQA was advised of the possibility of such damages.
Exceptions. Nothing in these Terms limits or excludes liability for:
- Fraud or fraudulent misrepresentation
- Gross negligence or willful misconduct
- Death or personal injury caused by negligence
- Any other liability that cannot be excluded or limited under applicable mandatory law, including under EU consumer protection laws or the Brazilian Consumer Defense Code
16. Indemnification
You agree to defend, indemnify, and hold harmless HearQA, its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your infringement of any third-party rights, including intellectual property, privacy, or publicity rights
- Any content you upload, transmit, or create through the Service
This indemnification obligation survives termination of your account and these Terms.
17. Termination
By you. You may terminate your account at any time by deleting your account through the portal settings or by using the contact form in your portal.
By HearQA. We may suspend or terminate your access to the Service immediately and without prior notice if you violate these Terms or engage in conduct that we reasonably determine is harmful to other users, HearQA, or third parties. For less severe violations, we will attempt to notify you and provide an opportunity to remedy the issue before termination.
Effect of termination. Upon termination:
- Your right to access and use the Service ceases immediately
- Your User Content will remain available for export for 30 days following termination
- After the 30-day period, your User Content will be permanently deleted in accordance with our data retention policy
- Any outstanding fees owed before termination remain due and payable
Provisions of these Terms that by their nature should survive termination (including Sections 8, 10, 14, 15, 16, 18, and 20) shall survive.
18. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to conflict of law principles.
Any disputes arising out of or related to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Belo Horizonte, Minas Gerais, Brazil.
Consumer protection exceptions. The choice of governing law and jurisdiction does not deprive you of the protection afforded by provisions that cannot be derogated from by agreement under the laws of your country of residence. In particular:
- EU/EEA consumers may bring proceedings in the courts of their country of residence, and benefit from the mandatory consumer protection laws of that country, in accordance with Regulation (EC) No 593/2008 (Rome I).
- Brazilian consumers may bring proceedings in the courts of their own domicile, in accordance with the Brazilian Consumer Defense Code (CDC, Law 8.078/1990).
19. Modifications to Terms
We may update these Terms from time to time to reflect changes to our practices, features, legal requirements, or business operations.
For material changes, we will provide at least 30 days' prior notice by:
- Sending an email to the address associated with your account
- Posting a prominent notice on the HearQA website
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree with the modified Terms, you may cancel your subscription and delete your account before the changes take effect.
We recommend reviewing these Terms periodically to stay informed of any updates.
20. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
21. Entire Agreement
These Terms, together with our Privacy Policy and Responsible Use Policy, constitute the entire agreement between you and HearQA regarding your use of the Service. These Terms supersede all prior and contemporaneous agreements, understandings, representations, and warranties, whether written or oral, regarding the Service.
No waiver of any provision of these Terms shall be deemed a further or continuing waiver of that provision or any other provision, and HearQA's failure to assert any right or provision under these Terms shall not constitute a waiver of that right or provision.
